Terms of Service

1. Service Description

LobsterHelper is a service operated by Trekkoa, Inc., a Delaware corporation ("Trekkoa", "we", "our", "the Service"). We provide managed hosting infrastructure for OpenClaw, an open-source AI assistant, and optionally provide managed AI API access through third-party providers (OpenAI, Anthropic, Google). We host OpenClaw assistants on your behalf. We are a managed hosting provider and, when you opt in, an AI access intermediary.

2. Eligibility

You must be at least 18 years old to use the Service. By creating an account, you represent and warrant that you are at least 18 years of age. If we learn that an account holder is under 18, we will terminate the account and delete all associated data.

3. What We Provide

  • Setting up and hosting OpenClaw assistants
  • Server uptime and availability
  • Standard security practices including encryption
  • Managed OpenClaw software updates on a tested schedule
  • Step-by-step setup guides and documentation
  • Dashboard for managing your assistants
  • Managed AI API access (on eligible plans)
  • Token usage metering and spend tracking

We provide instance security, not AI security. We secure the server infrastructure your assistant runs on — firewalls, encrypted connections, isolated environments, monitoring, and automatic restarts. We do not and cannot secure the AI model itself. AI assistants can be manipulated through prompt injection, social engineering, or adversarial inputs. They may hallucinate, disclose information you've shared with them, take unintended actions, or produce harmful content. These are inherent properties of the underlying AI technology, not defects in our hosting. Even when we provide managed AI API keys, we do not control the AI model's behavior. Managed keys simplify access — they do not add AI-level safety guarantees. We are not responsible for the behavior, outputs, or vulnerabilities of the AI model powering your assistant.

4. What You Are Responsible For

You, the user, are solely responsible for:

  • AI API keys and costs — if you use managed AI (included in your plan), usage is metered and subject to your plan's allowance. Overage is billed at cost. If you bring your own key (BYOK), all API costs are billed by your provider.
  • Messaging platform connections — you configure and maintain connections to WhatsApp, Telegram, Slack, Discord, or other platforms. You are responsible for compliance with those platforms' terms of service.
  • Skills and extensions — you choose which OpenClaw skills to install. We do not vet, endorse, or take responsibility for third-party skills.
  • Content generated by your assistant — any outputs, messages, or actions taken by your OpenClaw assistant are your responsibility.
  • AI security risks — including prompt injection attacks, jailbreaking, unintended data disclosure, and any other adversarial manipulation of the AI model. We recommend using a dedicated API key with spending limits and not sharing sensitive personal information with your assistant.
  • Data inside your assistant's environment — including conversations, configuration, API keys, and any files your assistant creates or accesses.
  • Compliance with applicable laws — including AI regulations, data protection laws, and local legislation in your jurisdiction.

We do not monitor your assistant. We do not review, screen, or moderate the content generated by your assistant or the messages it sends on your behalf. You are solely responsible for all outputs and actions of your assistant.

5. Data and Privacy

During normal operations, we do not access your conversations or API keys. We store only your account information (email, name) and billing data necessary to provide the service. However, no system is perfectly secure. If something goes wrong on our infrastructure, we can restore from backups. See our Privacy Policy for details.

6. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Attempt to access other users' assistants or data
  • Use excessive resources that degrade the service for others
  • Host malware, botnets, or participate in denial-of-service attacks
  • Send spam or unsolicited messages through your assistant
  • Mine cryptocurrency or run workloads unrelated to your OpenClaw assistant
  • Resell, sublicense, or share access to your assistant with third parties for commercial purposes

7. Suspension and Termination

We may suspend or terminate your account and assistants immediately if we reasonably believe you have violated these terms, including the Acceptable Use policy above. For non-urgent violations, we will make reasonable efforts to notify you and provide 7 days to remedy the issue before suspension. No refund is owed for any period of suspension or for termination resulting from your breach of these terms.

You may also request termination of your account at any time. See Section 8 for billing details upon cancellation.

8. Billing, Trials, and Cancellation

Subscriptions are billed monthly via Stripe and automatically renew each month at the then-current rate until cancelled. Subscriptions are available at Base ($19/mo), Pro ($39/mo), and Pro 10x ($149/mo). A BYOK option is available at $19/mo.

Free trial. New subscriptions include a 7-day free trial. You will not be charged during the trial period. At the end of the trial, your subscription will automatically convert to a paid subscription at the stated rate unless you cancel before the trial ends.

Cancellation. You may cancel at any time from your dashboard. Upon cancellation, your assistant will remain active until the end of your current billing period. After that, your assistant and all data within it will be permanently deleted. You may export your account data before cancellation.

Refunds. We do not offer refunds for partial billing periods. If you believe you were charged in error, contact us at support@lobsterhelper.com within 30 days.

Payment failure. If your payment method is declined, we will attempt to charge it again over the following 7 days. If payment is not received, your assistant will be suspended. Suspended assistants and their data will be permanently deleted after 30 days of continued non-payment.

Managed AI metering. Plans with managed AI include a monthly token usage allowance. Overage is billed at cost (wholesale rate, no markup). Usage resets each billing period.

9. Indemnification

You agree to indemnify, defend, and hold harmless Trekkoa, Inc. (d/b/a LobsterHelper) and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising from or related to: (a) your use of the Service, (b) content generated by your assistant, (c) your violation of these Terms, or (d) your violation of any third party's rights.

10. Limitation of Liability

The Service is provided "as is" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to: actions taken by your AI assistant, data loss within your assistant, costs incurred through your AI API provider, or any third-party claims related to your assistant's behavior.

To the maximum extent permitted by law, our total aggregate liability for any claims arising from or related to the Service shall not exceed the amounts you paid to Trekkoa in the three (3) months immediately preceding the event giving rise to the claim.

Neither party shall be liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to natural disasters, acts of government, internet or infrastructure outages, or failures of third-party service providers.

11. Open Source

OpenClaw is open-source software licensed under the MIT License by Peter Steinberger. LobsterHelper is not affiliated with or endorsed by the OpenClaw project. We charge for managed hosting infrastructure, not for the OpenClaw software itself.

12. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

Any dispute, claim, or controversy arising from or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in Wilmington, Delaware, or remotely at your election. The arbitrator's decision shall be final and binding.

You agree to resolve disputes individually. You waive any right to participate in a class action, class arbitration, or any other representative proceeding.

Notwithstanding the above, either party may seek injunctive or equitable relief in any court of competent jurisdiction. Claims eligible for small claims court in your jurisdiction may be brought there instead of arbitration.

13. Changes to Terms

We may update these terms from time to time. We will notify you of material changes via email at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.

14. General

These Terms constitute the entire agreement between you and Trekkoa, Inc. regarding your use of the Service. Our failure to enforce any provision of these Terms shall not be construed as a waiver of that provision. If any provision is found to be unenforceable, the remaining provisions shall remain in full force and effect. Trekkoa, Inc. reserves all rights not expressly granted in these Terms.
